Dear Friends:
In response to the recent seizure of 185 North Korean refugees by Thai authorities from a safe house in Thailand, the North Korea Freedom Coalition sent the following letter this morning to the Thai Ambassador to the USA. We urge others to send letters to the Thai Ambassador in their respective countries requesting these refugees be safely released to South Korea, the United States, or another country that will not repatriate them to North Korea. Please fax letters to the Thai Embassy at 202-944-3611.

Your Excellency,
The North Korea Freedom Coalition, a nonpartisan group of over 65 American and Korean American human rights, religious, and non-governmental organizations representing millions of American citizens, is gravely concerned for the fate of 185 North Korean refugees reported to be under arrest in your country.
As you know, hundreds of thousands of people have fled severe political persecution in North Korea, including arbitrary arrest, detention, torture, and starvation as a result of food being used as a weapon. The lives of 185 of these unfortunate souls, to include dozens of women and children, now depend on your country"s mercy, compassion, and commitment to its obligations under international law.
In 2004, the United Nations appointed one of your own country"s most distinguished legal scholars, Vitit Muntarbhorn, to be the United Nations Special Rapporteur on Human Rights in North Korea. Dr. Muntarbhorn"s final report concludes that because North Korea considers fleeing the country a criminal offense punishable by death, North Koreans who have fled to other countries should be considered "refugees sur place." This obliges nations not to repatriate refugees to North Korea, or to China, or to other countries which will repatriate them to North Korea, where they are likely to face imprisonment or execution. These obligations are detailed in the 1951 U.N. Convention on Refugees and its 1969 Protocol. Although Thailand is not a signatory to these conventions, it is nevertheless bound by customary international law not to refoul refugees to persecution. The world community has been grateful to Thailand for its past generous assistance to refugees and to upholding the principle of non-refoulement in its treatment of refugees.
Under Articles 2 and 3 of the Republic of (South) Korea Constitution, North Koreans are legally considered South Korean citizens. We are hopeful that South Korea will meet its international and constitutional obligations to accept these refugees. We also draw your attention to the North Korean Human Rights Act, by which the U.S. consular facilities must "facilitate the submission of applications" for asylum. Other agencies would later adjudicate the merits of each claim.

We respectfully urge your government not to repatriate these refugees to North Korea, China, or any state that will not respect its obligations under the 1951 Convention. We ask your government to arrange for the prompt safe passage of these refugees to South Korea, the United States, or another nation that will offer them a safe haven.
While we appreciate the reports from local Thai authorities that the refugees are being detained on a "humanitarian basis", we want to strongly emphasize to you that if they are repatriated to North Korea, or to a country like China that will repatriate them to North Korea, they will face certain and severe punishment, and even death, for the crime of fleeing their country.
We thank you in advance for your efforts to save the lives of these innocents and express our appreciation to the government of Thailand for its past action in allowing North Korean refugees safe passage.
